On adjusting the brightness settings (full brightness --> less) of the Jive remote.
The first thing happening is the back light + brightness is turned down to it's minimum values (the indicator bar isn't). after adjusting just a bit more, the back light turns back on and brightness is almost at it's peak level again (indicator at 80%). 
after this level the brightness function seems to work properly.

Also a brightness level of about 80% (indicated) also seem to fix the problem with the back light staying on when Jive device is in it's charger.

This is a known hardware issue with older boards.  Newer boards will not have this issue.
